From Public Defender to Prosecutor: A Unique Perspective on Justice
William Forrest Fischer
The roles of public defenders and prosecutors are often seen as opposing forces in the legal system, but in reality, they share more common ground than many realize. In this insightful session, Mr. Fischer will discuss his personal journey transitioning from a State Public Defender to a State Deputy Prosecuting Attorney in rural Idaho, offering a firsthand perspective on the challenges and professional insights gained from working on both sides of the courtroom. Through real-world examples, he will address:
The Overlaps Between Defense and Prosecution – How both roles aim to uphold justice, ensure due process, and protect the rights of defendants and victims alike.
Misconceptions About Each Role – Debunking common stereotypes about defense attorneys and prosecutors, and how those misconceptions impact public perception of the criminal justice system.
The Importance of Cooperation and Mutual Respect – How fostering a more collaborative relationship between defense and prosecution leads to better case resolutions, fairer outcomes, and a more efficient legal process.
Alternatives to Incarceration – The evolving role of prosecutors in supporting rehabilitation and treatment programs, and why a balanced approach benefits defendants, communities, and the justice system as a whole.
This session will provide valuable insights for legal professionals seeking to better understand the nuances of criminal law practice from both perspectives, and how working toward a shared goal of justice can create positive change in the system.
