There are unwritten rules of professionalism in baseball based on respect for the game. One of these rules is that you do not break up a no-hitter by bunting in the ninth inning. However, in the legal profession, courts have noted a lack of professionalism and civility among attorneys even though these traits are the mainstays of our profession and the foundations upon which lawyers practice law. In this interactive presentation, attorneys will learn the unwritten rules of professionalism in various sports including golf, hockey, baseball, football, basketball, and women’s soccer. We will watch film clips of various sports and decide whether these same concepts of professionalism can apply to the legal profession. We will discuss the rules of professionalism, how to deal with difficult attorneys, and how to improve professionalism in our daily practice of law.

In 2017 the Houston Astros won the World Series but were disciplined for cheating after it was discovered that they violated the rules of baseball by electronically stealing signs. Each week we read about disciplinary cases where attorneys are admonished, suspended, or disbarred for violating the Rules of Professional Conduct. In this presentation, we will review the Houston Astros cheating scandal, and then examine disciplinary cases and the types of conduct that result in suspensions or disbarment for attorneys. Further, we will review video clips from popular movies and determine if the conduct depicted in the movies violates any of the disciplinary rules.

Simpson trial to cinematic portrayals of legal battles, analyzing the fouls and fumbles made both on and off the legal mound. Whether it’s a misstep in technology, a swing-and-miss courtroom demonstration, or a curveball in cross-examinations, we’ll break down these blunders to refine our strategy and better our play. Let’s round the bases of expert testimony, pretrial prep, pleadings, and more, ensuring we’re ready for whatever pitch the courtroom throws our way.
Philip Bogdanoff is a nationally recognized continuing legal education speaker. He served as a senior assistant prosecutor in the Summit County, Ohio Prosecutor’s Office for more than 27 years. He still serves as a special prosecutor and in 2022 Argued three cases in the Ohio Supreme Court. He has taught members of numerous organizations including the National Association of Legal Administrators, National District Attorneys Association, and Ohio National Guard as well as over 50 bar associations, prosecuting attorney’s associations, and law firms.
